These Affiliate Terms govern the Moozgy affiliate programme, under which you earn commission when people you refer pay for Moozgy. They apply to creators and affiliates alike. In these terms, "Moozgy," "we," "us" and "our" mean the individual founder who owns and operates Moozgy as a sole proprietor, currently based in Italy. "You" means the person taking part in the programme.
These terms add to our Terms of Use and Privacy Policy, which also apply to you. On anything about the affiliate programme, these terms prevail if the two conflict.
Payouts are not running yet. Your commission is recorded from your first referred payment, but nothing can be paid until our payout system (Stripe Connect) is live. We will email you when payouts start. We do not promise a start date. See Section 7.
What changed on October 24, 2026. We added the Founding Creator rate (Section 4), its extra hold (Section 5) and a rule about its end date (Section 11). Section 9 now says that your link or code gives the people you refer no free trial or other perk of its own. Section 7 now sets payout dates. Once payouts are running, we pay on the 15th of each month, or the next business day. App Store commission is paid on the 15th of the month after Apple pays us for that payment, except that launch-rate commission is not paid before its charge is 90 days old. Website commission is paid on the first payout date on or after its hold ends. If we need longer to check a commission for suspected fraud or a breach, we hold back only that commission and email you the reason. Section 5 now counts an App Store payment as paid from the day Apple pays us, not from when we record it. For referrals credited to you before October 24, 2026, how much you earn has not changed: rates, the 12-month window, holds, the US$25 minimum and clawbacks are the same. The changes to Sections 5 and 7 apply to all commission credited to you under these terms, including commission credited before October 24, 2026. Since October 18, 2026, Section 1 has limited the programme to people and businesses that can receive payouts in the United States. Payouts are still not running, and this is not a start date.
1. Joining the programme
You must be at least 18, or the age of majority where you live if that is higher, and have a Moozgy account. You join by applying through moozgy.com and accepting these terms. We may decline an application. You take part as an individual or for a business you are authorised to bind.
For now, the programme is open only to people and businesses that can receive payouts in the United States. To be paid, you must set up a US Stripe Connect account. That needs a US address, a US bank account and a US taxpayer identification number, and Stripe may ask for identity, tax and bank details before it lets you receive money. We cannot pay a Stripe account in any other country. If that changes, we will update these terms. If you stop meeting this requirement, tell us. Commission already credited to you stays yours under Section 15.
2. Referrals
A referral is a person who reaches Moozgy through your affiliate link or code and then pays for Moozgy. A referred payment is a payment that person makes during the window in Section 4.
Whether a referral and its payments are credited to you, and to whom, is decided by the records our systems keep when the link or code is used. Our website remembers a referral link only where the visitor allows it, as our Privacy Policy explains. You can see the referrals and payments credited to you, and the state of each, in your affiliate dashboard.
If a referral was credited to you under the creator terms that applied from 15 September 2026, that referral keeps those terms. These Affiliate Terms apply to referrals credited on or after their effective date.
3. What commission is paid on
Commission is a share of what Moozgy receives, not of the price the referral sees:
- App Store purchases: the amount Apple pays us for that payment, after Apple's commission and any tax Apple deducts.
- Website purchases: the amount charged, less tax (such as VAT or sales tax) and Stripe's fees.
Apple's commission, taxes and payment-processing fees never earn commission.
4. Your commission rate
Unless the Founding Creator rate below applies, your rate depends on your qualifying net over the trailing 90 days. Qualifying net means your referred payments that are past their hold (Section 5), net of refunds.
| Tier | Qualifying net, trailing 90 days | Commission |
|---|---|---|
| 1 | under $1,000 | 15% |
| 2 | $1,000 to $4,999 | 20% |
| 3 | $5,000 and over | 25% |
Each month's tier applies to the referred payments credited to you that month. A tier is never applied retroactively: moving up does not raise commission on earlier months, and moving down does not reduce commission already credited.
The 12-month window. You earn commission on every payment a referral makes in the 12 months from their first paid charge, including renewals and upgrades. A free trial does not start the window. Payments after the 12 months earn no commission.
Founding Creator rate
For each referral first credited during the launch period, you earn 50% of what Moozgy receives (Section 3) on their launch-rate payments, instead of your tier rate. This applies to every affiliate in the programme, whenever you joined.
- Launch period. It starts at 00:00 Pacific Time on October 24, 2026, the effective date of this version, and ends at 23:59:59 Pacific Time on December 10, 2026. A referral is credited when your code is redeemed, or your link is recorded, for that person. It qualifies only if that is the first time the person has been credited to any affiliate.
- Launch-rate payments. The referral's first paid charge, and also their second paid charge if both are for a monthly plan. A charge that is later refunded still counts as one of these charges, and earns nothing. If the second charge is for another plan, such as an upgrade to yearly, it earns your tier rate.
- Example. At US App Store prices on October 17, 2026, Apple pays us $105.00 for a $149.99 yearly plan, so its one launch-rate payment earns you $52.50. Apple pays us $17.50 for a $24.99 monthly plan, so each of its two launch-rate payments earns you $8.75. Amounts differ by country, tax, price and store.
- After the launch-rate payments. The referral's other payments in the 12-month window earn your tier rate from the table above.
- Tiers. Launch-rate payments count toward your qualifying net in the same way as any other referred payment.
- Everything else applies unchanged. Section 1's age rule, the 12-month window, the holds in Section 5 (including the extra hold for launch-rate commission), Section 6 on refunds, upgrades and clawbacks, Section 7 on payouts and the US$25 minimum, and Sections 10 to 13 apply to launch-rate commission as they do to any other commission.
- The end date is fixed. Referrals first credited after the launch period earn your tier rate only. A referral credited during the launch period keeps the Founding Creator rate on its launch-rate payments, even if they are charged after December 10, 2026. The end of the launch period is part of these terms, not a change to them.
5. Holds
Commission becomes payable only after its hold ends:
| Payment | Payable |
|---|---|
| App Store | Only after Apple has paid us for that payment |
| Website, monthly plan | 60 days after the charge |
| Website, yearly plan, one-time purchase or gift | 120 days after the charge |
For App Store payments, "Apple has paid us" means Apple has paid us the proceeds that include that payment. The date Apple paid us is the payment date shown in Apple's payment records, not the date we record it. Until then, App Store commission shows in your dashboard but is not payable.
Launch-rate commission (Section 4) has an extra hold. It is not payable before the later of the day its hold above ends and the 90th day after the charge. Section 7 sets the day it becomes due, and it is paid on the first payout date on or after that day.
6. Refunds, upgrades and clawbacks
- Refunds. A refunded payment earns no commission. If a refund, reversal or chargeback happens before the commission is paid, we cancel that commission.
- Upgrades. If a referral upgrades, for example from monthly to yearly, the commission on the unused part of the plan they upgraded from is clawed back pro rata. The upgrade payment itself earns commission under Section 4.
- Refunds after payout. If a payment is refunded, reversed or charged back after we have paid you commission on it, we deduct that commission from your future earnings.
We recover a clawback only from your future earnings. We do not ask you to repay it, unless the commission was obtained in breach of Section 10 or 11, or by fraud, where Section 13 applies.
7. Payouts
Where things stand today. Payouts are made through Stripe Connect, which is not live yet. Until it is, your commission is recorded and accrues from your first referred payment, and nothing is paid. When payouts can run, we will email you. We do not promise a date. The payout dates below apply only once payouts are running, starting with the first payout date after that email. They are not a start date.
Payout date. Once payouts are running, we pay once a month, on the 15th. If the 15th is not a business day, we pay on the next business day. A business day is Monday to Friday, except a national public holiday in Italy, where we run the programme. For example, 15 November 2026 is a Sunday, so that month's payout date is Monday 16 November. All dates in this section are calendar dates in Coordinated Universal Time (UTC).
When each commission is paid. Each commission becomes due on the day set out below. It is paid on the first payout date on or after that day.
- App Store purchases: due on the 15th of the month after the month in which Apple pays us for that payment (Section 5). For example, if Apple pays us on 31 December, the commission is paid on 15 January. If Apple pays us on 2 January, it is paid on 15 February.
- Website purchases: due on the day its hold ends under Section 5. That is the 60th day after the charge for a monthly plan, and the 120th day after the charge for a yearly plan, one-time purchase or gift. For example, a hold that ends on 3 March is paid on 15 March. A hold that ends on 20 March is paid on 15 April. If a payout date has moved past the 15th, commission that becomes due on or before that moved date is paid on it.
- Launch-rate commission (Section 4): because of its extra hold in Section 5, due on the later of the day set out above for its purchase and the 90th day after the charge. For example, if a launch-rate App Store charge is made on 20 November and Apple pays us on 31 December, the commission is due on 18 February and paid on 15 March, not on 15 January. A launch-rate charge for a monthly plan on the website on 20 November is also paid on 15 March.
Review. Before each payout date, we check commission for refunds, fraud and breaches of these terms, and approve it. If we suspect fraud or a breach of Section 10 or 11 and need longer to check a particular commission, we hold back that commission only. We mark it "under review" in your dashboard and email you the reason. If the check clears it, we pay it on the next payout date.
Every payout:
- We pay by transfer to your Stripe Connect account. "Paid" means we send that transfer on the payout date. When the money reaches your bank depends on Stripe's payout schedule for your account. Until your Stripe Connect account can receive transfers, your commission waits, and it is paid on the first payout date after it can.
- The minimum payout is US$25. If your approved, unpaid balance on a payout date is below that after any deductions under Section 6, it carries over to the next payout date. Commission earned in another currency is paid in that currency, and we compare it with the US$25 minimum using the exchange rate we record for that payout run.
- Refunds, upgrades and refunds after payout are dealt with under Section 6 before each payout is made.
- We pay the Stripe Connect fees for sending your payout. Your bank, or Stripe's currency conversion into your bank's currency, may charge fees we do not control.
Your dashboard shows your next payout date once payouts are running. If that date depends on an Apple payment that has not happened yet, it is marked as expected and based on Apple's published payment calendar. The rules in this section decide the actual date. If there is no date yet, the dashboard says why.
8. Taxes
Stripe collects the tax forms and tax information it requires when you set up your Stripe Connect account. You are responsible for reporting and paying any tax on your commission. Commission amounts include any VAT, GST or similar tax you are required to charge. Where the law requires us to withhold or report tax on a payment to you, we will do so and tell you.
9. What your referrals get
Your link or code does not give the people you refer a free trial, discount or other perk of its own. They get the same prices and offers as anyone else. If we add a perk for your link or code, we will tell you and update this section. We choose the offers. You may describe only offers that are actually available when you publish, and you may not promise any trial, discount, bonus or price that we have not made available.
10. Disclosing that you are paid
You must tell your audience, every time, that you earn money when they sign up through you. The rules below follow the US Federal Trade Commission's Endorsement Guides (16 CFR Part 255) and its rule on consumer reviews and testimonials (16 CFR Part 465), the UK's CAP Code and CMA guidance, and the EU Unfair Commercial Practices Directive. Where your audience is in another country, its equivalent rules apply too.
- Disclose in the content itself. Put the disclosure in every post, video, story, stream, newsletter, article or message that promotes Moozgy, your link or your code. A disclosure only in your bio, profile, a links page or an "about" page is not enough.
- Make it impossible to miss. Put it before the link or the call to action, above any "more" cut-off, and not among a group of hashtags. In a video, say it out loud and show it on screen near the start. In a livestream, repeat it during the stream.
- Use plain words, in the language of the content: "Ad", "#ad", "Paid partnership with Moozgy", or "I earn a commission if you subscribe through my link". "Affiliate", "#sp", "#collab" or "thanks Moozgy" on their own are not enough. Where a platform offers a paid-partnership label, use it as well.
- Say only what is true for you. Speak from your own experience of Moozgy. Do not claim you used a feature you did not use, or results you did not have.
11. What you must not do
Breaking any of these rules is a breach of these terms.
- Paid advertising. Do not run paid ads of any kind that promote your link or code, including search, social, display and boosted or sponsored posts. Do not bid on "Moozgy" or any variant or misspelling of it as a keyword, and do not use it in a domain name, app name, account name or ad copy in a way that suggests you are Moozgy. These limits apply unless we agree otherwise in writing.
- Coupon and deal sites. Do not post your link or code on coupon, voucher, deal, cashback, rebate or loyalty sites, apps or browser extensions, or give it to anyone who runs one. Do not offer your own cash back, rebate or reward for signing up.
- Self-referral. Do not use your own link or code for your own purchase, or for a purchase made for you, on your behalf, or through an account you control. These earn no commission.
- Fake urgency. Do not use countdowns or timers, or say an offer is ending, is scarce or is "only for today". Moozgy does not use pressure, and nobody may use it on our behalf. The end of the Founding Creator rate (Section 4) is a date for your commission, not an offer to your audience. Do not tell your audience to sign up by that date, or that anything ends for them then.
- Medical, clinical or IQ claims. Moozgy is a mental-fitness product. Do not say or suggest that it diagnoses, treats, prevents or cures any condition, including ADHD, anxiety, depression, dementia or cognitive decline. Do not say it raises IQ, improves memory, grades or test scores, or is clinically or scientifically proven. You may describe it as hard problems that keep your mind working.
- Invented results. Do not make up or alter reviews, ratings, testimonials, scores, streaks, screenshots, user numbers or earnings. Do not present AI-generated people or testimonials as real.
- Misleading statements about Moozgy. Do not misstate Moozgy's prices, features or offers, or the terms of this programme. Do not present yourself as Moozgy, as working for Moozgy, or as speaking for us.
- Children. Moozgy is for people aged 13 and over. Do not direct your Moozgy promotion at children under 13.
- Spam and fake traffic. Do not send unsolicited email, messages or comments, and do not market to anyone without the consent the law requires. Do not use bots, scripts, fake accounts, purchased traffic or paid sign-ups to generate referrals.
- Unlawful or harmful content. Do not promote Moozgy alongside content that is unlawful, hateful, harassing, sexually explicit or that infringes anyone's rights.
12. Using the Moozgy name
While you take part, we give you a limited, non-exclusive, non-transferable and revocable licence to use the Moozgy name, and any logos and materials we provide, only to promote Moozgy under these terms. Do not alter our logos. The licence ends when your participation ends.
13. Breaches
If you breach Section 10 or 11, or obtain commission by fraud, we may:
- cancel the commission connected to the breach, including commission not yet paid;
- recover commission already paid on referrals connected to the breach;
- disable your links and codes; and
- end your participation under Section 15.
Where a breach can be fixed, we will normally ask you to fix it first. We do not need to do that for fraud, self-referral, medical claims or a repeated breach.
14. Your data, and your referrals' data
About you. We keep your name, email and Moozgy account; your links and codes; the referrals and payments credited to you and the state of each; your payout and clawback records; and your Stripe account ID. We use them to run the programme and pay you, which is necessary to perform these terms; to keep the records tax and accounting law requires; and to prevent fraud, which is our legitimate interest. Stripe collects the identity, tax and bank details it needs to pay you, under its own terms and privacy policy. We store your Stripe account ID, not your bank details. Payout and commission records are kept as long as tax and accounting law requires. Our Privacy Policy covers international transfers and your rights, and tells you how to contact us about your data.
About your referrals. Your dashboard shows referred payments and their states. It never shows the names, email addresses or other personal details of the people you referred. Do not try to identify them through Moozgy.
Your own audience. When you promote Moozgy, you are responsible for complying with privacy and marketing laws towards your own audience, including consent for email and messaging.
15. Ending your participation
You may leave the programme at any time by writing to us (Section 19). We may end your participation, or the programme, by giving you 30 days' notice by email. We may end your participation immediately for a breach under Section 13.
When your participation ends, your links and codes stop working, and payments made after the end date earn no commission. Commission on payments made before the end date stays yours, except under Section 13, and becomes payable under Sections 5 to 7.
Sections 6, 8, 13, 14, 16 and 18 continue to apply after your participation ends.
16. Relationship and liability
You are an independent contractor. Nothing in these terms makes you our employee, agent, partner or representative. You may not make promises or enter into agreements for Moozgy, and you have no authority to negotiate or conclude sales for us. The programme is not exclusive on either side.
You are responsible for your content. You agree to compensate us for losses we suffer because your content, or your breach of these terms, breaks the law or infringes someone's rights.
Sections 16 (Disclaimer of warranties) and 17 (Limitation of liability) of the Terms of Use apply to the programme. To the extent the law allows, our total liability to you under these terms is limited to the greater of the commission paid or payable to you in the 12 months before the claim arose, or US$100. Nothing in these terms limits liability that cannot be limited by law.
17. Changes to these terms
We may change these terms. Each version shows its own effective date at the top of this page and applies from that date.
- Earned terms are kept. A referral credited to you keeps the commission terms in force when it was credited. That covers the rate rules, the window and the holds, for the rest of its 12 months.
- Notice. We will email you at least 30 days before a change that reduces what you can earn.
- Conduct rules apply from their effective date. Changes to Sections 10 to 14 apply to everyone from their effective date, so we can follow changes in the law and on platforms.
If you do not accept a change, you may leave under Section 15. If you keep taking part after the effective date, you accept the changed terms.
18. Governing law and disputes
These Affiliate Terms and any dispute arising out of them are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, except where mandatory law of your habitual residence applies and cannot be derogated from by agreement. Section 18 of the Terms of Use (informal resolution, binding individual arbitration, class action waiver and 30-day opt-out) applies to disputes under these terms. Subject to it, any claim not subject to arbitration shall be brought exclusively in the state or federal courts located in California, and the parties consent to their jurisdiction.
Section 20 of the Terms of Use (assignment, severability, no waiver, force majeure) also applies. Changes to these terms are governed by Section 17 above.
